General Terms and Conditions of the Seeblick Holiday Village
1. Scope
The following general terms and conditions apply to all offers, reservations, and contracts relating to all vacation properties rented by Feriendorf Seeblick GmbH. These general terms and conditions apply exclusively; other contractual terms and conditions do not become part of the contract, even if they are not expressly contradicted.
2. Reservations and conclusion of contract
By making a reservation, the guest offers Feriendorf Seeblick, represented by Feriendorf Seeblick GmbH, to conclude a contract for the rental of accommodation. The customer can make the reservation in person, by telephone, in writing, by email, or via the booking portal. Reservations from minors are not accepted. Feriendorf Seeblick GmbH reserves the right to reject a reservation without stating reasons. Travel documents must be checked immediately upon receipt for completeness and accuracy. Feriendorf Seeblick GmbH is no longer obligated to comply with any requests for changes after the contract has been concluded.
3. Compliance with the contractual terms and conditions
After the start of the trip, the accommodation may no longer be handed over for use or assigned to persons other than those named in the booking confirmation or registration form, unless this is agreed upon in writing between the parties. Until the start of the trip, guests may request that third parties assume the rights and obligations arising from the contract. In this case, the guest and the new tenant are jointly and severally liable for the travel price and any additional costs. In case of violation, Feriendorf Seeblick GmbH may terminate the rental agreement at any time without notice.
4. Prices
a) By receiving the written booking confirmation, the guest agrees to pay the price stated therein. Only the travel price stated in this confirmation is binding for the booking. Discounts and/or special offers can no longer be used after the reservation confirmation has been sent by Feriendorf Seeblick GmbH.
b) All prices include VAT (unless otherwise stated).
c) If, after the conclusion of the contract and the start of the trip more than three months later, the value added tax increases due to changes in legal regulations, the travel price shall increase by the same percentage as the increase in value added tax; Feriendorf Seeblick GmbH will apply this increase as soon as possible after the increase comes into effect, but no later than 14 days before the start of the trip.
d) In addition to the travel price, the locally applicable tourist tax/tourist and other fees, if applicable, the rental cost of bed linen (optional), as well as fees for other incidental costs/services, pets, etc., as per the currently valid price list, must be paid. Travel cancellation insurance is not included in the travel price. This must be purchased by the guest/renter with an insurer of their choice.
5. Payments
The fees for the rental accommodations are to be paid as stated on the invoice. After the payment deadline(s) have expired, Feriendorf Seeblick GmbH may withdraw from the contract, and the guest is fully liable for any damages incurred, including costs associated with the reservation and contract termination. The provisions of Article 6 apply. Any amounts already paid will be offset against cancellation fees and any applicable reimbursements for other expenses. The tenant must pay the full rental price even if they believe that the accommodation does not meet their expectations despite the description of the rental premises.
6. Cancellation
The tenant is entitled to cancel the booking. For reasons of preserving evidence, the cancellation must be made in writing. The cancellation becomes effective on the day it is received by Feriendorf Seeblick GmbH. The cancellation fee per accommodation is 10% of the total rental price from the start of the rental agreement.
up to 29 days before the start of the rental period: 0% of the rental price
from 28 to 8 days before the start of the rental period: 80% of the rental price
from 7 days before the start of the rental period: 100% of the rental price
provided that re-letting of the accommodation was not possible. Partial cancellations are not possible. If the guest does not arrive, the travel price will not be refunded, not even partially, and the obligation to pay the same remains. The same applies to early departure. Travel cancellation insurance is recommended.
7. Rebooking
At the guest's request, Feriendorf Seeblick GmbH will, where feasible, make a change to the confirmation (rebooking) for a fee. This only applies to rebooking a specific date. Other and subsequent changes can only be made by withdrawing from the travel contract under the conditions set out in Article 6 and simultaneously re-registering.
8. Force majeure
Force majeure exists if the fulfilment of the contract by Feriendorf Seeblick GmbH is prevented - possibly temporarily - in whole or in part or made disproportionately difficult by circumstances over which Feriendorf Seeblick GmbH has no influence, such as storms/storm damage, threat of war, strikes, blockades, fire, pandemics, flooding and other unforeseeable disruptions or events, etc. In these cases, Feriendorf Seeblick GmbH is entitled to terminate the contract without notice or to cancel the booking.
9. Liability
The liability of Feriendorf Seeblick GmbH for damages that do not constitute physical injury is limited to the travel price for all contractual claims for damages: a) if the damage to the traveler was caused neither intentionally nor through gross negligence, or b) if Feriendorf Seeblick GmbH is solely responsible for damages incurred by the traveler due to the fault of a service provider. If statutory provisions apply to a travel service to be provided by a service provider, according to which a claim for damages only arises or can be asserted under certain conditions or restrictions, or is excluded under certain conditions, Feriendorf Seeblick GmbH can invoke these provisions against the traveler. Liability is excluded for all non-contractual claims for damages that do not concern injury to life, limb, or health, unless they are based on a grossly negligent breach of duty by Feriendorf Seeblick GmbH or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of the same. Feriendorf Seeblick GmbH assumes no liability for valuables brought in by the tenant. Feriendorf Seeblick GmbH GmbH is not liable for noise disturbances caused by third parties or other guests.
10. Use of rental accommodation
All tenants and their guests must treat the accommodations and furnishings with care. The tenant is responsible for any damage, regardless of fault. The tenant is responsible for the behavior of persons belonging to their household, visitors, suppliers, or employees. Complaints must be reported immediately to Feriendorf Seeblick GmbH or its on-site representative as part of the obligation to cooperate, who will ensure immediate remediation if possible. The tenant is responsible for cleaning the accommodations regularly and leaving them in a clean and tidy condition (e.g., washing dishes, disposing of rubbish, or cleaning the fireplace grill are not included in the final cleaning). Any additional cleaning work required to ensure re-letting beyond the scope of the final cleaning will be invoiced to the tenant retroactively, depending on the amount of work involved. If bed linen has been rented from Feriendorf Seeblick GmbH, we ask our guests to remove it before departure. Pets are generally permitted. Fighting dogs and listed dogs are not permitted on the premises. Open fires are not permitted. Visitors’ vehicles and their own second vehicles must be parked outside the holiday village grounds.
11. Complaints
Despite all efforts on the part of Feriendorf Seeblick GmbH, you may occasionally have a complaint as a guest. This complaint must be reported to Feriendorf Seeblick GmbH immediately so that it has the opportunity to remedy the situation.
12. Travel documents
Each guest is responsible for having valid travel documents (identity card, passport) for themselves and their fellow travelers.
13. Arrival and Departure
Arrival: from 4:00 PM to 6:00 PM (afterwards only by prior arrangement!)
Departure: until 10:00 a.m.
14. General
In accordance with local regulations, every guest must be able to identify themselves without being asked to do so by means of valid official identification; otherwise, accommodation may be refused. For safety reasons, setting up tents next to the holiday homes is not permitted. Maintenance work on the accommodations will be tolerated by the guest. If Feriendorf Seeblick GmbH has reasonable grounds to suspect that the tenant of an accommodation is acting illegally and/or contrary to public order and/or common decency, Feriendorf Seeblick GmbH is entitled to gain access to the rental property and, if necessary, expel the guest from the premises or ban them from the premises. The holiday village regulations as of June 1, 2023, and subsequent annual amendments are an integral part of these General Terms and Conditions. Obvious printing errors are not binding on Feriendorf Seeblick GmbH. These General Terms and Conditions supersede all previous publications. Any ancillary agreements, amendments, or additions to this contract must be in written form to be effective.
15. Final provisions
The guest confirms that the personal information provided is correct. By registering, the guest accepts the General Terms and Conditions, including the holiday village regulations and house rules. The statutory provisions and the law of the Federal Republic of Germany apply. The place of jurisdiction for all disputes arising from the rental agreement is Amberg for both parties. Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In place of the invalid provision, a valid provision that most closely approximates the invalid provision shall apply.
